    These Terms of Service ("Terms") govern your access and use of Headw.ai's analytics platform ("Service"). By using the Service, you agree to these Terms. The following definitions apply:

    • Agreement includes these Terms and Order Forms
    • Service means Headw.ai's marketing analytics platform
    • Customer refers to the business entity subscribing
    • Customer Data means data imported or generated through service use

    2. Service Terms

    We grant you a non-exclusive, non-transferable license to use the Service subject to these terms:

    • Access limited to authorized business users within your organization
    • No unauthorized access sharing or reselling of the Service
    • Customer maintains ownership of their data
    • Technical support provided according to subscription level

    3. Customer Obligations

    • Maintain account and access security
    • Provide and maintain accurate registration information
    • Comply with applicable data protection laws
    • Use service only for legitimate business purposes
    • No reverse engineering or competitive analysis

    4. Data & Privacy

    • Customer retains ownership of all Customer Data
    • We analyze usage data to improve our services
    • We may use aggregated anonymous data
    • Data handled according to our Privacy Policy
    • Data available for export before account termination

    5. Fees & Payment

    • Subscription billed as specified in Order Form
    • 30-day notice provided for any price changes
    • Service may be suspended for late payments
    • No refunds for partial subscription periods
    • Customer responsible for applicable taxes

    6. Confidentiality

    Both parties agree to protect confidential information shared during the business relationship. This includes customer data, business information, and technical details about the Service.

    7. Term & Termination

    • Service starts on the effective date in Order Form
    • Subscriptions auto-renew unless cancelled
    • 30-day notice required for cancellation
    • Immediate termination available for material breach
    • Data available for 30 days after termination

    8. Warranties & Liability

    • Service provided "as is" without warranties
    • No guaranteed uptime or specific results
    • Liability limited to 12 months of subscription fees
    • Force majeure applies to service interruptions
    • No liability for consequential damages
